Residence permit „special cases of gainful employment“
The residence permit "special cases of gainful employment" covers a number of different groups of persons whose activities are excluded from the scope of the Foreign Employment Act (Ausländerbeschäftigungsgesetz, AuslBG).

Who can receive a residence permit "special cases of gainful employment"?
The residence permit "special cases of gainful employment" can be granted for the following activities:
- crew members in cross-border maritime and inland waterway transport
- for education and training or research programs of the European Union
- for exchange teachers or language assistants at educational institutions and universities within the framework of intergovernmental agreements and exchange programs
- for students and graduates in the framework of a mutual exchange programs, provided that the exchange is carried out through associations of which either an Austrian university is a member or which cooperate with an Austrian university
- for au-pairs for a maximum of 12 months • for trained specialty cooks and top chefs in the upscale gastronomy from China for a maximum period of three years
What are the requirements for a residence permit “special cases of gainful employment"?

Can family members get a residence permit in Austria?
Yes. Family members can apply for a residence permit “family unity”.
Exception: Family members of a holder of a residence permit „special cases of gainful employment“ as au pairs cannot be granted a residence permit.
